Vybs (the “Company”, “we”, and “us”) is committed to protecting the information You provide to the Service. We respect all applicable legislations concerning the protection of your privacy as well as those of all our members, applicants, hosts, and attendees.

1. INTRODUCTION

Your privacy is a top priority to us. The policy set forth here (the “Privacy Policy”) is our commitment to protecting your privacy and describes the information we collect and how that information may be used. By using our application (the “app”), certain features thereof, or related services, including, but not limited to, those related to hosting and joining activities created by members or otherwise disseminated through the app (collectively, the “Service”), you are agreeing to be bound by the terms described herein. This Privacy Policy applies to all uses by You of the Service.

This Privacy Policy is periodically reviewed and updated to reflect changes in the law, our data collection and use practices, and the features of our Service. The last date of update will be posted near the top of this page. Your continued use of the Service will mean You consent to and accept the latest Privacy Policy. If you do not consent to such changes you can terminate your account at any time as described in our Terms of Use.

2. AGE POLICY

YOU MUST BE 18 YEARS OF AGE OR OLDER. Only applicants 18 and over will be considered for acceptance and are allowed to use the Service. However, Vybs is not liable if an applicant lies about their age in their application. Should we become aware of a user who is not at least 18 years of age, we will immediately remove that user from our Service. We do not knowingly collect, maintain, or use information from children under the age of 18.

3. INFORMATION COLLECTED

Upon registering or using the Service, some of your personal information is collected by Vybs. For example, that may include phone number, demographic information, IP addresses, device-specific information such device type, operating system, universally unique identifiers (UUID), and device tokens to diagnose issues and send device-specific notifications. This information is used strictly to verify your identity and to enable the notification and location based features within the Service. You will also be asked to allow us to collect your geographical location information and you may respond to such a request by allowing us to collect location information at all times, only while you are using the App or not at all. This geographical data serves to find and designate activity meeting locations and the disclosure of such location is available only when You have approved other members requested to join your activity. Vice versa, You will not be able to see the locations of other activities unless you have been approved by the hosting member. In addition, we may collect some personal information you provide in connection with your application, while using our Service, which include primarily your name, gender, hometown, birthday, and telephone number. In connection with your use of the Service, you may also provide us images, song selections, a biographical description, and gender preferences for the activities you join or host. By choosing to provide this information, you consent to our processing of it. Any information you provide may be viewable by other users of the Service. If you communicate with other users within the Service, you provide us the content of your conversation. Should you contact us with an inquiry, we may collect the content of that correspondence or interaction.

In addition to the information you provide, certain information will be automatically collected as you use the Service, including, but not limited to, the operation system used by your device, your device type and ID, your IP address, how and how often you interact with other users and your access times. If you grant us permission to use location services, we will automatically collect data regarding your geographical location at all times or while the App is actively running, depending on the permission that you grant us. Your geolocation data is not used for any purpose other than finding activity locations near you. We may use cookies and similar technologies to recognize you and/or your device. This may be done to, among other reasons, authenticate you, and remember your preferences and settings.

4. USE OF INFORMATION

Vybs will not share or sell your personal information with any third parties without your consent, unless required by a lawful order, to provide information or any such assistance to Government Agencies who are lawfully authorized for investigative, protective, cyber security activity, in furtherance of any statutory obligations that Vybs may have. By accepting this Agreement, You agree and authorize Vybs to share your personal information with third parties except as necessary to provide You with the services offered by Vybs, with third-party vendors, consultants and service providers who need access to this data to carry out their work for Vybs, to protect the rights or property of Vybs, in an emergency to protect the personal safety of Vybs employees, or any other person. Vybs may use your personal information to verify your identity or check your qualifications. Vybs may also use your contact information to inform You of any changes to the Service.

Vybs may use information that we collected from you to, among other things, (1) Create and manage your account, (2) Deliver and improve the Service, including developing new features, (3) Facilitate and monitor use, content and interactions among users, (4) Perform research, analysis and analytics internally or by using a third party service, (5) Manage our business, (6) Communicate with you, and (7) Enforce or exercise rights under our Terms of Use. The primary reason we collect and process your information is to perform the designed Services offered by the app. As you go about using our Service and participating in meaningful activities, we use your information to maintain your account and your profile, to make it viewable to other users, and to show activities near you. We may also use your information for the purpose of improving the features in the app, such as analyzing users’ behavior to improve the Service. And finally, we process information for administrative, fraud detection, filter profane languages or images, and other legal purposes.

When you register as a user of the Service, your app profile will be viewable by other users of the Service. Such other users will be able to view information you have provided to us such as your name, photos you uploaded, your age, hometown, your biography, and information you have in common with the person viewing your profile, such as mutual interests. Only members you have accepted to join your hosting activity may converse with you and other members through the Service before the activity expires. Vice versa, you may only be able to communicate with other members when you have been accepted by a hosting member to participate in their activity. Should you engage in a conversation through our Service via text chats, that user with whom you are communicating will see the content of that interaction.

Only members whose applications have been accepted by Vybs will be able to see your app profile. Applicants who have been waitlisted will have no way to know or see that you are a member of the Vybs community just as users cannot see which applicants have been waitlisted.

For compliance purposes, Vybs may be required to disclose your information in connection with such as legal matters and to ensure compliance, or a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency.

In addition to the uses of your personal information referenced above, we may use and share non-personal, non-identifiable information we collect through your use of the Service with third parties such as advisors, investors, and professionals for purposes related to our business.

5. SECURITY

We take the security of your information very seriously. We put forth our best efforts, but no system is guaranteed to be perfectly secured. While we continually take reasonable actions to regularly update and improve our security, including regularly monitoring our systems for possible vulnerabilities and attacks and regularly reviewing our information collection practices, we do not promise, nor you should expect, that your information, chats, or other communications will always remain secure. We have no liability to you or to any third party arising out of any loss, misuse or alteration of your personal information. Users outside of the United States should note that your information may be transferred to our servers which are hosted within or outside the United States. By using the Service you consent to the transfer of your information to countries which may not provide the same level of protection available in your country of residence. If you believe that your account or information is no longer secure, or otherwise have information that may be relevant to us regarding information security, please reach out to Vybs immediately at www.vybs.app.

Your information is kept at Vybs Service for as long as you are an active approved member in the app. Should you choose to delete your account, we will proceed to delete or anonymize your information immediately unless: (1) An information must be kept to comply with applicable law, (2) Outstanding issue, claim, or dispute requiring us to keep the relevant information until it is resolved, or (3) the information must be kept for our legitimate business interests, such as fraud prevention and enhancing users' safety and security. We strived to carry out data deletion processes according to the above guidelines, but we cannot promise that all data will be deleted within a specific time frame if there are technical constraints.
